1. Introduction
Welcome to the Mass Disposal Tool (the "tool"). This Tool is operated by Australian Pork Limited (ABN 83 092 783 278) ("APL", "we", "us", "our"). By using the Tool, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Tool.
2. Mass Disposal Tool Background
In the event of an emergency animal disease (EAD) outbreak, there may be a requirement for the mass disposal of animals on a property to reduce disease spread and/or for animal welfare purposes. Preparedness for mass disposal during an EAD outbreak is an important responsibility of the pork industry. The Mass Disposal Tool enables producers to prepare for this scenario by identifying suitable burial sites that comply with relevant legislative requirements.
The Tool allows producers to enter site-specific information to assist with disposal planning and calculates the disposal requirements based on the information provided. It also provides access to information relevant to the selected site, including applicable legislative requirements.
Once all required information has been entered, the Tool generates a downloadable PDF report. The report summarises the information entered and provides an assessment of the suitability of the selected burial site. The Tool can be used multiple times, allowing producers to assess and compare the suitability of different burial sites.
3. Purpose of the Tool
The Tool is designed to generate a report that provides recommendations on the suitability of a selected burial site for the mass disposal of pigs, including an assessment of compliance with relevant legislative requirements within the applicable jurisdiction.
The Tool allows users to:
- Input site-specific data.
- Access information and resources relevant to their site.
- Generate a report summarising the burial site assessment, including a recommendation on the suitability of the selected disposal site.
4. Privacy
By using the Tool, you consent to the collection, use, and disclosure of your personal information as outlined in our Privacy Policy, in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
5. User Accounts
To use certain features of the Tool, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6. Data Ownership and Control
You retain ownership of all first-party data you upload or generate through the Tool. We do not claim ownership of your data and will not use it for secondary purposes without your consent.
Data will only be disclosed:
- To third parties with your express permission.
- Where required by law (e.g. for biosecurity compliance).
- In aggregated, de-identified formats that cannot be linked back to you or your property.
7. Data Use and Sharing
You can view, download, and request the deletion of your data at any time, subject to legal and regulatory obligations.
8. Data Security
We take all reasonable steps to:
- Protect your data from unauthorised access, misuse, or loss.
- Ensure data integrity and accuracy.
- Notify you in accordance with the Notifiable Data Breaches scheme if a breach involving your personal or farm data occurs.
9. Intellectual Property
All content, features, and functionality of the Tool, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of APL or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Tool without the prior written consent of APL. Your use of the Tool does not grant you any rights to our intellectual property except as required to use the Tool lawfully.
10. Prohibited Uses
You agree not to use the Tool:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
- To impersonate or attempt to impersonate APL, an APL employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Tool, or which, as determined by us, may harm APL or users of the Tool or expose them to liability.
11. Termination
You may delete your account at any time through the Tool.
We may terminate or suspend your access to the Tool immediately if you breach these Terms, you misuse the Tool, or we are required to do so by law. Upon termination, your right to use the Tool will cease immediately and we may retain your data only as required by law or with your permission.
12. Limitation of Liability
To the fullest extent permitted by law, in no event will APL, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Tool, including any direct, indirect, special, incidental, consequential, or punitive damages.
Our liability for breaches of consumer guarantees under the Australian Consumer Law is limited to the re-supply of services or the cost of doing so.
13. Disclaimer
To the fullest extent permitted by Law, by using the Tool you acknowledge and agree that APL does not represent, warrant or guarantee that:
- the Tool will be free of all errors, and
- the Tool will be available, accessible and able to be used at any given time, or for any given period.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Australia to resolve any dispute arising out of these Terms or the Tool.
15. Changes to Terms
We may, acting reasonably, revise and update these Terms from time to time by notifying you in writing, including by notifying you when you use the Tool. All changes are effective immediately when we post them and apply to all access to and use of the Tool thereafter. Your continued use of the Tool following the posting of revised Terms means that you accept and agree to the changes.
16. Dispute Resolution
Informal Negotiations: To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Mediation: If the dispute is not resolved within 30 days of written notice, either party may refer the matter to mediation in accordance with the Resolution Institute’s Mediation Rules. The mediation will be conducted in Canberra, Australia, unless otherwise agreed, by a mediator appointed by mutual agreement or, failing that, by the Resolution Institute, and in English and at shared cost (unless otherwise determined by the mediator).
Mediation must be attempted in good faith before any arbitration proceedings commence.
Binding Arbitration: If the dispute remains unresolved after mediation, the matter must be submitted to binding arbitration in accordance with the Resolution Institute’s Arbitration Rules. Arbitration will be conducted under the applicable Commercial Arbitration Act of the Australian Capital Territory, and by a single arbitrator appointed by agreement, or by the Resolution Institute if agreement cannot be reached. The language of the proceedings shall be English. The governing law of these Terms shall be Australian Capital Territory.
The decision of the arbitrator will be final and binding on both parties and may be enforced in any court of competent jurisdiction.
Restrictions: The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
17. MISCELLANEOUS
These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these Legal Terms and the lack of signing by the parties hereto to execute these Legal Terms.
